injury. Arcose measured "average noise," while | was subjected to "asymmetric
pressure."

IV. REGULATORY FRAUD & PERMITTING VOID

A forensic audit of the City of Burnaby’s permit database—covering 317 records—confirms a
total absence of permitting for the Fall 2025 OMC1 renovation.

e The Point of Contrast (Exhibit G): My search identified one active permit for the
site, (BLD23-00648) for a separate $1,000,000 server room project. This proves the
employer understands the legal requirement for permitting but intentionally bypassed
all municipal oversight for the OMC1 classroom.

e The Violation: By circumventing the permit process, the employer operated a
"hack-job" installation that violates NFPA 75/76 (Fire Protection of IT Equipment) and
NFPA 90A (Return-air plenum violations).

e The Impact: Had a municipal inspector been called for a mandatory permit, this
installation would have been flagged as a hazard before it could cause my Tonic
Tensor Tympani Syndrome (TTTS).

V. PROOF OF TECHNICAL EXCELLENCE

The employer’s claim that | "did not obtain the required minimum passing grade" is a
documented mischaracterization. As shown in the Course Report (Exhibit H):

e Quantitative Mastery: Mid-Course Average of 89.9% and a Final Written Exam of
87.6%.

e Professional Endorsement: The Lead Instructor’s narrative confirms my technical
knowledge is "very high," my performance is "professional," and | am a "strong
candidate” for the role.

VI. CONCLUSION

My technical performance proves my dedication; my injury proves the employer's
negligence. | request that WorkSafeBC invalidate the Arcose report and adjudicate based on
the documented Engineering Failures and my Jan 22 Safety Concern (Exhibit D).
