January 23, 2026 β€” WhatsApp Communication with Instructor

At 1:47pm on January 23, | sent the following message to my instructor Sonya (Exhibit | β€”
WhatsApp Chat Log):

{Jan 23, 13:47] Mark Holand: β€œMy ears physically hurt today, and | have had progressively
worse headaches this week. If | have to, | will put a refusal for unsafe work. To subject one
employee to that noise for a day, a week, a month without hearing protection is cruel."

At 4:12pm the same day, | raised the testing methodology question directly:

{Jan 23, 16:12) Mark Holand: "Did safety take samples throughout the day (constant monitoring
and data logging) or did they do samples on the spot. One time samples are NOT indicative of
the overall day. What about when the servers get hot, and the fans spin up? What sound level
samples were obtained during those times? Or was it basically while the system is at idle. There's
a BIG difference."

This question β€” raised on January 23, 2026 β€” is precisely the methodology deficiency
documented in Finding 1 below. Arcose conducted their survey on March 6, 2026 and made the
same error | predicted six weeks earlier.

The instructor's response at 2:23pm confirmed the employer's prior knowledge:

January 25, 2026 β€” Speech Intelligibility and Academic Disadvantage
At 10:38am on January 25, | documented the specific impact on my ability to learn:

I can rarely fully hear any questions Sandeep asks. Workstation 3 is at a disadvantage,
academically, compared to the other Workstations."

This is a Speech Interference Level complaint β€” in plain language β€” filed in writing with my
instructor on January 25, 2026. The TSI SoundPro DL-1 instrument used by Arcose has Speech
Interference Level testing capability. Arcose did not run this test, despite my exact concern
being documented and available.

At 10:50am the same day, | formally asked about upgrading to a workplace injury:
