CMO006 How to Read a Disclosure + The worker’s legal counsel requests WorkSafeBC records for court purposes. There is a fee for this type of disclosure. Supplemental disclosure If a disclosure has previously been issued and the same party requests further disclosure, then a partial disclosure may be made which only includes documents not previously disclosed as part of that prior disclosure. The supplemental disclosure package includes documents that were not part of the prior disclosure (and which are not “draft” or otherwise subject to retention due to FIPP rules). Example: The worker has requested and received disclosure of their claim file. After receiving a decision letter on a matter, the worker again requests disclosure of the claim file. Only documents that were not part of the first disclosure will be sent in response to the second request. Freedom of Information and Protection of Privacy Act If the disclosure that you have requested is not related to a proceeding such as a review or appeal, the provisions of the Freedom of Information and Protection of Privacy Act (FIPPA) apply. You may find records included in the disclosure redacted in accordance with the FIPPA. How the file is organized Here is a list of the sections you may find in the file, along with examples of documents you can expect to find in each section. Note: The file may not include all of these sections. It will include only the sections that have documentation. e Accounts: All copies of invoices paid on the claim before May 2009. For invoices paid after May 2009, details are captured in the Claim Data Report. Note: On occasion, there may be copies of manually processed invoices displayed in the Accounts section. e Appeal: Documents related to reviews and appeals of the claim. * Claim Data Report: Information about the claim, including eligibility and entitlements. Details from telephone conversations are located under Plan Events. Note: Telephone conversations are either located in Phone Log or Claim Data Report. Please refer to both sections for complete telephone correspondence. + Claims Corr (Claim correspondence): Copies of documenis and other information that we have sent to — or received from — the worker, the employer, and anyone else involved. » Disclosure Document: Documents relating to requests for information. + Earnings Equivalency: Information about the earnings, and calculations of the wage rates. + Key Forms: The application for compensation, and the employer’s report — or the report from the owner/operator. + Legal: Documents from our legal department, and other court documents.
