WorkSafeBC claim file disclosure guide

A claim file disclosure may have many different
types of documents, some that were created by
WorkSafeBC as part of the process of handling
the claim, and some that were sent to us by the
worker, employer, or others. We've divided the
documents into sections (see list below), with
each section sorted chronologically.

[Claim file disclosures

The type of disclosure and what is included will
depend on the circumstances that trigger the
disclosure and whether the disclosure was
specifically requested, and by whom.

A claim file is disclosed:

When a review or appeal of a decision is
requested

* a worker or employer requests that the Review
Division review a WorkSafeBC decision. All
documents, except draft documents, up to
the date of the disclosure are provided. The
package of disclosed documents is provided
to the worker and to the employer (and their
respective representatives, if any).

a worker or employer appeals a WorkSafeBC
Decision or Review Division decision to the
Workers Compensation Appeals Tribunal. All
documents, except draft documents, up to
the date of the disclosure are provided. The
package of disclosed documents is provided

to the worker and to the employer (and their
respective representatives, if any).

NOTE: Employers are only entitled to disclosure
of the claim file when there is a request for
review or appeal of a decision.

When the worker requests disclosure:

+ a worker (or their representative) may request a
disclosure, at any time, of:

¢ The entire claim file, or
+ The medical documents only, or
« The invoices/accounts only

All applicable documents, (except draft
documents and documents restricted from
disclosure under Freedom of information and
Protection of Privacy legislation), up to the date
of the disclosure are disclosed. The package of
disclosed documents is provided only to the
worker (and their representative, if any).

+ a worker (or their representative) requests
a disclosure of the claim file soon after a
decision letter has been issued. Al! documents,
except draft documents, up to the date of
the disclosure are provided. The package
of disclosed documents is provided only to
the worker (and their representative, if any).
Documents normally restricted from disclosure
under Freedom of information and Protection
of Privacy legislation are included in this
disclosure.
