EMPLOYER STALLING β€” FORMAL COMPLAINT

| also wish to place on formal record that BCRTC has failed to produce
basic audiometric and acoustic testing data after more than six weeks.

| raised this concern with you approximately two weeks ago. The employer
continues to stall.

| want to ask WorkSafeBC directly: where is BCRTC's audiometric data?
Where is their acoustic assessment? A dosimeter test takes one day.
Six weeks have passed. This delay is not administrative. It is

deliberate. Every week of delay is another week | have no access to
wage loss payments and funded medical treatment.

The adverse employment action letter and the stalling of acoustic

testing data occurred in the same week. Both actions serve to minimize
BCRTC's liability while an active WorkSafeBC investigation is underway.

| am requesting WorkSafeBC note this pattern and take appropriate action
to compel the employer to produce the outstanding data immediately.

| am requesting that WorkSafeBC:

1. Document this adverse employment action in my claim file

2. Assess whether this action constitutes retaliation against an
injured worker under the BC Workers Compensation Act

3. Formally compel BCRTC to produce their acoustic testing data
without further delay

4. Note that the employer's stalling is directly impacting my access
to wage loss payments and medical treatment funding
