Hi Erika, Thanks for following up regarding Mark Holand. This has become a complex case with some nuances that should be made known. Similar to your experience, since early March, Mark Holand has requested that BCRTC only communicate with him via email/secure email from record keeping purposes since lodging a “WorkSafe BC Prohibited Action Investigation” and does not respond to phone calls. On January 12, Mark transferred from his previous position as a Guideway Serviceperson to the Control Operations department at BCRTC and became completing necessary training. On January 19, Mark began experiencing headaches, bilateral eye pain and loss of sleep attributed to a noisy server fan from one of the desks in the control department training room. A comprehensive investigation was completed by BCRTC’s safety department which revealed that the sound levels were within normal WSEBC thresholds as outlined in the WSBC denial letter. In my initial phone discussion with Mark on February 3, he confirmed suffering from pre-existing migraines which were well-managed. On or around March 24, Mark was relieved from his position as Control Operator as he did not successfully pass the necessary training. He was reassigned back to his usual position as a Guideway Serviceperson to which he took exception to and lodged a grievance/protest. Occupational Health issued an Occupational Fitness Assessment (OFA) to his Physician on March 24 to better understand his prognosis for return to work as a Guideway Serviceperson to which his Physician noted some physical and psychological restrictions. A further follow-up medical questionnaire was issued to his Physician on April 3 Inquiring about Mark’s ability to participate in a modified return to work in an office/administrative capacity to which we received no correspondence. Mark was also no longer responding to email reminders or inquiries from Occ Health which prompted involvement of our Labor Relations department. Our Labor Relations department issued Mark with a Notice to Comply Letter and deadline to submit this requested information. The deadline of May 8 lapsed and Mark provided another generic medical note extending his absence till June 15. | am happy to discuss this further should you require more information or context.
