g. Within an hour of sending that letter, you responded and advised that you would provide
a completed copy of the questionnaire by April 30, 2026, deadline.

However, notwithstanding the foregoing, you have failed to provide us with a completed version
of the questionnaire. Instead, you have simply provided us a generic three sentence note from
your physician which indicates that you are unable to work and are not expected to be able to
return until June 15, 2026 and which is nearly identical to the March 9, 2026, letter.

While this note purports to be responsive to our previous requests for medical information from
you, it clearly falls well short of what could be considered “responsive.” It does not address the
questions set out in our previous questionnaire, nor does it even attempt to address why you are
incapable of returning to work with a workplace accommodation, what such accommodation might
entail or why your anticipated return to work date continues to shift.

Put another way, we do not consider this note to be a reliable medical opinion concerning your
absence from work, or your current and future ability to regularly and reliably report to work and
perform employment duties, with or without a workplace accommodation.

Accordingly, and as set out in our April 24, 2026, letter, you are currently AWOL as your
absence continues to be unsupported. This, in turn, means that your employment with
B.C. Rapid Transit Company is currently in serious jeopardy of being terminated.

To avoid such consequences, it is imperative that you take the questionnaire that has previously
been provided to you to your physician or specialist, and have them complete it and return it to
us. We expect that any answers provided will be appropriately responsive to the questions set
out in our questionnaire, and that such answers will be provided to us, at the latest, by May 8,
2026, or such other date as may be mutually agreed.

If your physician or specialist is unable or unwilling to assist you, we are prepared to help facilitate
an assessment with an independent medical specialist, so long as you request one by the
deadline set out above. We also remind you of our EFAP resources which are available to all
employees, and which can be accessed at httos://www.homewoodhealth.com or (1-800-663-
1142).

Mark, we strongly urge you to comply with the directions provided in this correspondence. A
failure to do so will place your continued employment in jeopardy.

Please be assured that any medical information we receive will be kept confidential in accordance
with our applicable legal obligations.

Lastly, if there are any other medical or health circumstances of which we should be aware, we
ask that you advise us of same.
