Departments at WorkSafeBC

You may interact with other departments at WorkSafeBC besides Prohibited Action Complaints,
for example, Prevention Services and Claims Services. Please note that each department is
separate, and information is generally not shared between departments in accordance with the
Freedom of Information and Protection of Privacy Act. As a result, if you feel that another
department has documents needed for us to decide your prohibited action complaint,
you must provide those documents to us directly.

Prohibited Action Complaints is a neutral decision-making tribunal for workers to submit
complaints against their employers or unions when they experience retaliation for raising
occupational health and safety concerns or unsafe conditions. We cannot fix occupational health
and safety concerns or unsafe conditions. We only address the negative impact of actions taken
by your employer or union related to your employment or union membership. Also, we do not
provide legal advice.

Prevention Services is the department that investigates occupational health and safety concerns
and unsafe conditions. They may issue an inspection report to fix the occupational health and
safety concerns or unsafe conditions.

Claims Services manages workers’ claims for compensation once they receive a report about a
work-related injury or illness. If there are documents on your claim file to support your
prohibited action complaint, you must provide those documents directly to us.
